This is the Website Privacy Policy ("Privacy Policy") of Lee Equity Partners, LLC ("Lee Equity", "we" or "us"). An important part of our commitment to you is our respect for your privacy as a user of this website (the "Site"). This Privacy Policy applies only to the Personal Information that we may collect through the Site and does not concern any third-party website to which the Site may link.

If you are a Lee Equity employee, you will have seperately received our Employee Privacy Notice. 
 
1. The Information We Collect About You
 
We may have collect the categories of Personal Information listed below about you in connection with your access and/or use of the Site.
  • Identifiers and Verification Information. We may collect information you submit as part of completing online forms on the Site (including, but not limited to, name, address, and contact information).
  • ​​Communications Data. We may collect Personal Information that you provide when you contact us for any reason, such as to express an interest in obtaining additional information about our services, or to direct questions or concerns about our services to us.
  • Information Collected by Cookies. Our Site may use cookies to collect information about the services that you use and how you use them, which may include device-specific information, your navigation throughout the Site, and other technical and browsing preferences, including your location and entry point to the Site. We may use both Session Cookies and Persistent Cookies: a Session Cookie disappears after you close your browser; a Persistent Cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site. 2. How We Use Your Information
 
Your Personal Information may be collected, stored, disclosed and processed by Lee Equity for the following purposes:
 
  • To operate, maintain, enhance, and provide all of the features of the Site; 
  • To personalize the Site, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Site; 
  • To understand and analyze the usage trends and preferences of our users, to analyze and report on the Site’s traffic, marketing and usage trends, to improve the Site, and to create new features and functionality.
  • For ongoing review and improvement of the information, content and services provided on the Site to ensure it is user friendly;

  • For in-depth threat analysis, to prevent any potential disruptions such as cyber-attacks, and for statistical monitoring and analysis of current attacks on devices and systems for the on-going adaption of the solutions provided to secure systems and devices against current attacks;
  • To provide you with the services for which you subscribe, and to allow you to use and access any functionality provided by the Site;
  • To inform you about news and information relating to our business and services (generally, you can opt-out of receiving our promotional communications through links provided in the messages or by contacting us directly using the contact information provided below in Section 8);
  • To understand your needs and interests and respond to inquiries, and/or other requests or questions;
  • To detect, investigate and prevent fraud and other crimes or malpractice, and to improve fraud detection and information security; 
  • For the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings), and to obtain legal advice or to establish, exercise or defend legal rights;
  • To confirm and verify your identity and to conduct due diligence; 
  • For the management and administration of our business, and to comply with our contractual obligations; and
  • For purposes otherwise set out in this  Privacy Policy or any other notice provided to you at the time we collect your Personal Information. 

Some jurisditions require us to state the legal bases for processing your Personal Information. As applicable, Lee Equity is entitled to process your Personal Information under one or more of the following legal bases applies:

  1. Lee Equity needs to do so in order to perform its contractual obligations to you (for example, in order to manage your investments and verify the information you provide);
  2. Lee Equity has obtained your specific and informed consent (which may include written consent), unless an exemption provided under applicable law permits the use and disclosure of your Personal Information without your consent;
  3. Lee Equity has legal or regulatory obligations that must be discharged;
  4. Lee Equity may need to do so in order to establish, exercise or defend its legal rights or for the purpose of legal proceedings; or
  5. the use of your information is necessary for our legitimate business interests or the legitimate interests of a third party, provided such interests are not overridden by your rights or interest, including (i) allowing Lee Equity to effectively and efficiently administer and manage the operation of its business; (ii) maintaining compliance with internal policies and procedures; (iii) monitoring the use of our copyrighted materials; (iv) offering optimal, up-to-date security solutions for mobile devices and IT systems; and (v) for internal research purposes.

If you are located in a jurisdiction which requires us to obtain your consent to collect, use, store, process and disclose your Personal Information, you understand that by providing your Personal Information in connection with your access or use of the Site, you consent to Lee Equity collecting, using, storing, processing and disclosing your Personal Information as set out in this Privacy Policy.

 

3. When We Disclose Information
 

Lee Equity does not disclose you Personal Information to other people or nonaffiliated companies except when we have your permission, as required by law, and/or under the following circumstances:

  • We work with third party service providers to provide website development, hosting, data storage, maintenance, and other services for us.  To the extent it is necessary for these third party service providers to complete their contractual obligations to us, these third parties may have access to or process information about you.  
  • We may partner with certain third parties to collect information regarding your use of our Site in order to improve our maintenance and support. These third parties may set and access cookies on your computer or other device. If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. Please note that certain aspects of our Site may not work correctly if you block cookies. Any third party plugins and components are governed by the privacy policy of the company providing them (and not this Privacy Policy), so we advise you to read their privacy statements.
  • In some cases, in order to provide the services available through and/or in connection with the Site, we provide information about you to trusted partners who work on behalf of or with us under confidentiality agreements. 
  • We may partner with third parties to manage our advertising on other websites.  Our third party partners may use tracking technologies to gather information about your activities on our Site and other websites to provide you with advertising based on your browsing activities and interests.  
  • We may share information about you in response to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • We may share information about you in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by applicable law.

4. Your Rights
 
Depending on the jurisdiction in which you reside, you may have certain legal rights in relation to your Personal Information. These rights may include:
 
  • Declining to share certain information with us, in which case we may not be able to provide to you some of the features and functionality of the Site;
  • Requesting and obtaining information regarding how Lee Equity may use your Personal Information;
  • In some circumstances, requesting and receiving some Personal Information about you that you have provided to Lee Equity;
  • In some circumstances, requesting that Lee Equity correct your Personal Information if it is inaccurate or incomplete;
  • In some circumstances, requesting that we erase your Personal Information (but please note that there may be circumstances where we are legally entitled to retain Personal Information regardless of any such request);
  • In some circumstances, requesting that we restrict or block our processing of your Personal Information (again, there may be circumstances where we are legally entitled to refuse that request); and
  • Where applicable, the right to lodge a complaint with the data protection regulator in your jurisdiction if you think that any of your rights have been infringed by Lee Equity.

5. How We Protect Your Information
 
  • Data Security.  We use certain physical, managerial, and technical safeguards that are designed to protect the integrity and security of your information.  We cannot, however, ensure or warrant the security of any information you transmit to us through the Site and you do so at your own risk.  We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.  We cannot control the actions of other users or other third parties with whom you may choose to share your information.  Therefore, we cannot and do not guarantee that information you post through the Site will not be viewed by unauthorized persons.  We are not responsible for circumvention of any privacy settings or security measures contained on the Site.  
  • Data Retention.  We only store your information for as long as may be needed to provide services to you, with the exception of information that we may need to store for a longer period of time to comply with legal or regulatory obligations, resolve disputes, enforce our agreements, or for records management purposes.  Even after removal, copies of information that you have posted may remain viewable in cached and archived pages or if other users have copied or stored such information.
  • Protecting Children.  Our Site and our services are intended for use by individuals over the age of 18.  We do not knowingly collect information from individuals under the age of 18.  If you are under 18 years of age, then please do not use or access the Site at any time or in any manner.  

 

6. International Visitors
 
This Site is controlled and operated by Lee Equity in the United States.  If you choose to access the Site from outside the United States, you acknowledge that you will be transferring your information, including Personal Information, outside of those regions to the United States for storage and processing, as necessary to provide to you the services available through the Site and you consent to such transfer.
 
7. Other Important Information
 
  • Changes and Updates to this Privacy Policy.  We reserve the right to make changes to this Privacy Policy at any time.  We will notify you about significant changes in the way we treat your information, including by placing a prominent notice on the Site or by sending you an email so that you can choose whether to continue using the Site.  Material modifications are effective 30 calendar days after our initial notification or upon your acceptance of the modified privacy policy.  Immaterial modifications are effective upon posting of the updated privacy policy on the Site.  Please revisit this page periodically to stay aware of any changes to this Privacy Policy.  For the avoidance of doubt, disputes arising hereunder will be resolved in accordance with the Privacy Policy in effect at the time the dispute arose.
  • Governing Law. This Privacy Policy is governed by Delaware law. Any dispute regarding this Privacy Policy or your use of the Site shall be resolved solely in the state or federal courts located in Delaware.
  • Limitation of Liability.  By accessing the Site and/or providing us with Personal Information and/or other data, to the extent permitted by applicable law, you expressly and unconditionally release and hold us harmless from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the use and/or misuse of such information.  In addition, while we take efforts to ensure the proper and appropriate use of data by our service providers that may receive your information from us, we are not responsible for any injuries, loss, or damage of any kind arising from or in connection with the use and/or misuse of your information caused by those service providers.
  • Third Party Websites.  The Site may provide links to, or features from, other third party websites. If you link to or use such third party sites or features, you do so at your own risk. This privacy policy for California residents (this “California Policy”) is provided in addition to the information in any other privacy notice provided by Lee Equity Partners, LLC ("Lee Equity," "we," or "us"), and explains Lee Equity’s online and offline collection, use, and disclosure of Personal Information (as defined by the CCPA) relating to residents of the State of California (collectively, "you") covered by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, together with any applicable regulations (all together, the “CCPA”). Any terms defined in the CCPA have the same meaning when used in this California Policy. This California Policy is available in alternative formats upon request. This California Policy applies solely to California residents and does not apply to information collected, processed or disclosed by Lee Equity pursuant to the Gramm-Leach-Bliley Act and its implementing regulations, or the California Financial Information Privacy Act. We may amend this California Policy from time to time, and will provide you with such amendments in the same manner in which you have received this form.

 

1. NOTICE OF COLLECTION, USE RETENTION, AND DISCLOSURE OF PERSONAL INFORMATION

a. Sales and Sharing of Personal Information. We do not and have not sold any categories of Personal Information to third parties or shared any categories of Personal Information for the purpose of cross-context behavioral advertising.

We may collect the following categories of Personal Information about you online and/or offline when you become an investor, as well as in the course of administering our investment program:

Identifiers, including your name and contact details (i.g. home and email address, home and mobile phone numbers), social security number, passport number, unique personal identifier (e.g., device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology), online identifier, Internet protocol address, and other similar identifiers;

Other Records, including your signature, physical characteristics or description, state identification card (including driver’s license) number, insurance policy number, education information, information obtained as a result of your investment in any of our funds (such as advisor details, investment details, banking details, and financial details), as well as banking and insurance information, tax information, your social insurance or Medicare or social security number or other tax identification number and details of tax residency, and other financial information;
  3. Protected Classifications, including under California or federal law, such as national origin, age, sex, marital status, medical condition and immigration or citizenship status;
  4. Commercial Information, including your investment information, financial products or investment services purchased, obtained, or considered, and other investing or consuming histories or tendencies, as well as data about your capital account, capital contributions, profit and loss allocations and distributions and withdrawals from our funds, as well as information about other transactions with us, our affiliates or others, such as participation in our investment programs or products;
  5. Online Activity, including your Internet and other electronic network activity information (e.g., browsing history, search history, and information regarding your interaction with websites, applications or advertisements);
  6. Employment Information, including your professional or employment-related information;
  7. Inferences, including inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes; and
  8. Other information, including the information you create or provide to us, such as the content of your communications with us and/or with our representatives, service providers and affiliates, including in-person discussions, telephone conversations, and electronic or other communications.

We do not knowingly collect or solicit any categories of Personal Information from any individual under the age of eighteen (18).

i. No automated decision-making. We do not use computer algorithms to make automated decisions based on your Personal Information. We may process some of your Personal Information automatically, with the goal of assessing certain personal aspects related to you (profiling), in order to comply with our legal or regulatory obligations, such as to combat money laundering or terrorism financing.

Know: You have the right to request, twice in a 12-month period, that we provide (A) certain information about the (1) the categories of Personal Information we have collected about you; (2) the categories of sources from which the Personal Information is collected; (3) the business or commercial purpose for collecting your Personal Information; and (4) the categories of third parties with whom we have shared your Personal Information; and / or (B) the specific pieces of Personal Information we have collected, used, and disclosed about you during the past 12 months.
  2. Deletion: You have the right to request that we delete certain Personal Information we have collected from and about you and to tell our service providers to do the same.
  3. Correction: You have the right to request that we correct or amend certain Personal Information we maintain about you if it is inaccurate.
  4. Limit: You have the right to request that we limit the use and disclosure of Sensitive Personal Information we have collected. To the extent we collect any Sensitive Personal Information from or about you, we will use it only for the purposes listed above in Section 1(e). As such, any Sensitive Personal Information that we collect does not come within this right to limit use and disclosure. 
  5. Opt-out: You have the right to opt-out of the sale of your Personal Information to third parties and/or the sharing of your Personal Information for certain purposes. As noted in Section 1(a) above, Lee Equity does not sell or share Personal Information to or with third parties.
  6. Non-Discrimination: You have the right not to experience discriminatory treatment and we will not discriminate against you because you have exercised any CCPA privacy rights. We do not use the fact that you have exercised or requested to exercise any CCPA rights for any purpose other than facilitating a response to your request.

b. How to Submit a Request.

c. Verifying Your Requests.

To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your Personal Information or complying with your request. If we are successful in validating your identity, we will respond to your request within the time and in the manner required by CCPA. If we are unable to verify your identity, we will need to deny your request. We reserve the right to deny requests in certain circumstances, such as where we have a reasonable belief that the request is fraudulent.

  1. Verification Process. If you request to know, access, delete, and/or correct your Personal Information, we may require you to provide any of the following information: address, date of birth, unique personal identifier, state of residence, telephone number, email address, or details of a transaction. In addition, if you ask us to provide you with specific pieces of Personal Information, we may require you to sign a declaration under penalty of perjury that you are the individual whose Personal Information is the subject of the request. We will use the information you submit and the information we have in our systems to try to verify your identity and to match the Personal Information we have collected about you, if any, to your identity.
  2. Authorized Agent. If you designate an authorized agent to make an access or deletion request on your behalf, we may require you to (1) provide the authorized agent written permission to do so (e.g., via a notarized letter), and (2) verify your own identity directly with us (as described above) and confirm with us that you provided the authorized agent permission to submit the request.

d. Additional California Privacy Disclosures.

  1. Do Not Track Signals. Your browser and other mechanisms may permit you to send do-not-track signals or other similar signals via your browser settings to express your preferences regarding online tracking. Due to the lack of any standard for how do-not-track should work on commercial websites, we do not currently respond to such signals.
  2. Shine the Light Notice. California residents have the right to request and obtain from us, once a year and free of charge, certain information about the categories of their Personal Information (if any) that we disclosed to third parties for direct marketing purposes including the names and addresses of all third parties with whom we shared your information for direct marketing purposes in the immediately preceding calendar year.
